Welcome to BeSeen Jewelry. These Terms of Service (“Terms”) govern your use of our website and the purchase of our 14k gold and natural diamond jewelry. By using our site, you agree to these terms.

1. Professional Eligibility

By using this site, you represent that you are at least 18 years of age and have the legal authority to enter into a binding contract. If you are using the site on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

2. Products & Accuracy

A. Handcrafted Variations

Every BeSeen piece is crafted with natural diamonds and 14k gold. Because we use natural materials:

  • Gemstones: Slight variations in color, internal inclusions, and "Total Carat Weight" (typically within +/- 0.05ct) may occur.
  • Imagery: We strive for photographic accuracy, but your screen’s display settings may affect how colors and scales appear.

B. Pricing & Errors

We reserve the right to correct any pricing errors or inaccuracies, even after an order has been placed. In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel the order for a full refund.

3. Orders & Cancellations

  • Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to decline or cancel any order for reasons including, but not limited to, product availability, errors in description, or suspected fraud.
  • Modifications: Once an order for a Custom or Personalized piece has entered production, it cannot be modified or canceled.

4. Intellectual Property

All content on this site—including designs, logos, product names, photography, and text—is the exclusive property of BeSeen Jewelry.

  • Limited License: You may download or print pages for personal, non-commercial use (e.g., as a gift reference).
  • Prohibitions: You may not reproduce, "scrape," or use our jewelry designs or imagery for commercial purposes without express written consent.

5. Payments & Security

  • Authorization: By providing payment details, you warrant that you are the authorized user of the payment method.
  • Third-Party Processing: We utilize secure, PCI-compliant third-party processors. BeSeen Jewelry does not store your full financial data.

6. Shipping & Returns

Your use of our services is also governed by our Shipping Policy and Refund Policy, which are incorporated into these Terms by reference. Please review them to understand our 5-day notification requirement and 15-day return window.

7. Limitation of Liability

To the fullest extent permitted by law, BeSeen Jewelry shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from the use of our products.

Note: Our total liability to you for any claim shall not exceed the actual amount paid by you for the specific product in question.

8. Warranty Disclaimer

Our jewelry is provided "as is" without warranties of any kind, either express or implied, except for any specific authenticity certificates (e.g., GIA/IGL) provided with your purchase. We do not warrant that the website will be error-free or uninterrupted.

9. Governing Law

These Terms are governed by the laws of the United States and the State of New York. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in New York.

  1. Carat Weight Clause: In the jewelry industry, "Total Carat Weight" (TW) can vary slightly. Adding a disclaimer for +/- 0.05ct is standard and protects you from customers claiming a "0.98ct stone isn't the 1.0ct I ordered."
  2. Pricing Error Protection: Protects you if a $5,000 ring is accidentally listed for $500 due to a technical glitch.
  3. Intellectual Property Protection: Specifically mentions "scraping" and "jewelry designs" to prevent competitors from stealing your unique styles or photos.
  4. Liability Cap: Limits your financial exposure to exactly what the customer paid, preventing "punitive" or "emotional" damage claims.
  5. Integration: Explicitly links the Shipping and Refund policies so they all work together as one legal unit.
